Construction under time and cost pressure: dialogue between law, business and local governments – expert panel during the Autostrada Nowa Infrastruktura Expo
These include, without a doubt, the speakers of the panel "Construction under time and cost pressure: dialogue between law, business and local governments", organised by the JDP Drapała Chomiuk & Partners law firm, one of the leaders in legal advice and legal representation for contractors, private investors, and subcontractors in the implementation of complex infrastructure investments, which brought together four outstanding specialists on one stage. The feasibility of schedules, liability for delays, the accumulation of penalties, and the limits of their admissibility were discussed in a lively discussion by Engineer MSc. Maciej Gładyga – who gained professional experience, among others, through over ten years of work in the ministry responsible for transport, serving, among others, as deputy director of the Department of EU Funds and deputy director of the Department of Rail Transport. Since 2016, he has been the Managing Director of the Chamber of Commerce for Land Transport and is responsible for all substantive work of the IGTL. As vice-president of the European Rail Freight Association, he provided numerous examples of railway investments in which effective cooperation with subcontractors played a key role and presented the difficulties faced by entities initiating investments in the transport sector. Together with Arkadiusz Arciszewski, responsible for the implementation of several key infrastructure investments in Poland, the President of the Management Board of Transkol in Kielce and the Director of the Railway Construction Department at MIRBUD SA, one of the largest infrastructure construction contractors in Poland, they tried to show the way to the most effective cooperation between the investor and the contractor. Arkadiusz Arciszewski pointed out very important issues in the field of construction law that can significantly hinder not only cooperation but also the implementation of the investment. He supported this with numerous examples from his extensive experience in implementing projects of national significance. What if an agreement between the investor and the contractor is not possible without external support? The presentation extensively highlighted the legal aspects of disputes in the construction industry and ways of resolving them. Urszula Pierzchała, representing Contract Solutions Expert Arcadis and a court expert, licensed engineer, and mediator. Urszula Pierzchała has extensive knowledge and a holistic approach to construction disputes and, based on her extensive experience in this field, she outlined possible areas of difficulty in mediation as well as the motivations and role of evidentiary documentation. Together with Maciej Grzybowski, Senior Associate at JDP Drapała Chomiuk & Partners Law Firm, the guests gathered the options available to parties in situations requiring legal intervention and what may be most beneficial for the company. They pointed to the still-underestimated role of mediation, which can often limit the escalation of conflict but is still not the most frequently chosen solution in disputes. The panel was moderated by Mateusz Biciutko, Associate at JDP Drapała Chomiuk & Partners Law Firm, who, with commitment and subject-matter expertise, questioned the panellists in detail about the most crisis-prone situations and ways to address them in the road infrastructure industry.
